This is a legal agreement between you and Rolling Innovations LLC (“Rolling Innovations,” “we,” “us”) governing your use of the EasyPhotoShow software (the “Software”). By clicking “I Agree” during installation, or by installing, activating, or using the Software, you agree to the terms below. If you do not agree, do not install or use the Software.
1. License Grant
Subject to your compliance with this Agreement and payment of the applicable license fee, Rolling Innovations grants you a personal, non-exclusive, non-transferable license to install and use the Software on computers you own or control, for your own personal or household use.
This license is granted to you as an individual, not to an organization, unless you have separately arranged a different license with us in writing. You may not resell, sublicense, rent, lease, or otherwise transfer the Software or your license to any other person.
1A. Organizational License (Organization Tier)
If you purchased an Organization license, this Agreement instead covers use by the organization (such as a church, funeral home, or similar organization) on whose behalf the purchase was made. That organization’s staff and volunteers may install and use the Software for the organization’s own purposes, on computers owned or controlled by the organization. An Organization license may not be shared with, or extended to, any other organization, and may not be resold or sublicensed. All other terms of this Agreement apply equally to Organization licenses.
2. What You May Not Do
You may not:
- a) redistribute, sell, or share the Software or your license key with others;
- b) reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits this despite this restriction;
- c) remove or alter any copyright, trademark, or other proprietary notice contained in the Software;
- d) use the Software in any way that violates applicable law.
3. Your Content
The Software processes photos, video, and audio files that you choose to provide as input (“Your Content”). Your Content remains yours. We do not access, collect, transmit, or claim any ownership interest in Your Content. Rendering and export happen entirely on your own computer.
4. Free Trial
The Software may be evaluated under trial conditions (limited photo count and video length) before purchase. Purchasing a license removes these limits. See our Refund Policy for how the trial relates to purchase decisions.
5. License Activation and Termination
Your license is activated using a license key tied to the email address used at purchase. This license terminates automatically if your purchase is refunded or reversed (including by chargeback). Continued use of the Software after such termination is not authorized under this Agreement.
6. No Warranty
THE SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH EVERY COMPUTER CONFIGURATION.
You are responsible for keeping your own backup copies of any photos, video, or audio files you use with the Software. The Software is not a backup or archival tool.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROLLING INNOVATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
8. Third-Party Components
The Software includes third-party open-source components and licensed music. See the accompanying THIRD-PARTY-NOTICES file, installed alongside the Software, for details and attribution.
9. Support
Support is provided on a reasonable-efforts basis by email at info@rollinginnovations.com. We do not guarantee a specific response time or availability of support.
10. Governing Law
This Agreement is governed by the laws applicable to Rolling Innovations LLC’s principal place of business, without regard to conflict-of-law principles, except where mandatory consumer protection law in your jurisdiction provides otherwise.
11. Entire Agreement
This Agreement, together with our Refund Policy and Privacy Policy (available at easyphotoshow.com), constitutes the entire agreement between you and Rolling Innovations LLC regarding the Software.
